The company POZUZ, s.r.o., ID No.: 28134818, Těšínská 403, 373 61 Hrdějovice, represented by the managing director Ondřej Kubart, as a personal data controller, thanks its clients for contacting our company and our business partners (suppliers and customers) for cooperating with us. We would like to inform you about the basic elements of personal data protection in our company, your rights in the area of GDPR and the possibility to contact us if you wish to exercise your rights in the area of GDPR against us or file a complaint.

I. Legal conditions for the collection and processing of personal data

I.1 We process personal data in accordance with the legislation of the Czech Republic and the European Union. These are in particular the following legal regulations and their implementing regulations:

  • (a) Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC ("GDPR"),
  • (b) Act No. 101/2000 Coll., on the Protection of Personal Data, as amended,
  • (c) Act No. 253/2008 Coll., on Certain Measures against the Legalization of the Proceeds from Crime and the Financing of Terrorism, as amended,
  • (d) Act No. 89/2012 Coll., the Civil Code, as amended.

II. What personal data we process

II.1 We only process such data to enable us to supply and assemble our products to you and to receive goods from our suppliers for the purpose of manufacturing and assembling our products, to comply with our legal obligations and to protect our legitimate interests.

II.2 We process the following categories of personal data:

Basic identification data:

Basic identification information is part of every contract you enter into with us. These include
such as name, date of birth and home address. For entrepreneurs, the business registration number and address
headquarters.

Contact details

Contact details include email, phone number, contact address.
Only with your consent (see below) can we publish your photos in the company newsletter
or on the website of POZUZ, s.r.o.

III. Purpose of the processing of personal data

III.1 Processing without your consent

  • (a) Processing in compliance with a legal obligation

POZUZ, s.r.o. processes personal data for the purpose of fulfilling its obligations under the law. These include in particular: tax, accounting and labour law regulations, Act No. 89/2012 Coll., Civil Code, as amended, and Act No. 253/2008 Coll., on certain measures against the legalization of proceeds of crime and terrorist financing, as amended.

In addition, the processing is necessary for the handling of complaints pursuant to Act No. 89/2012 Coll., the Civil Code.

  • (a) The processing is necessary for the performance of the contract or for the implementation of measures taken before the conclusion of the contract

In the case of your request for goods and services, we require and subsequently process
the following personal data:

For the We will contact you form: name and surname, phone number.

For the ON-LINE Request form: name and surname, telephone number, e-mail address,
contact address, building address, content of the request, text in the note.

The above data must be processed in order to create a service offer, negotiate this
offer or to answer a question you have raised.

Furthermore, we process your data on the basis of a contract we enter into with you. In such
your direct consent to the storage and processing of your personal data is not required
and you cannot refuse to provide this information. If you would prefer not to provide the data,
there could be no contract with you.

  • (b) The processing is necessary for the purposes of the legitimate interests of the controller

The legitimate interest of POZUZ, s.r.o. is the defence of legal claims and the protection of property against theft (monitoring of the outdoor areas of the production facilities Trägerův Dvůr 117,37010 České Budějovice, at the address of the registered office of POZUZ, s.r.o. and in the outdoor areas of the storage centre in České Budějovice by a camera system.)

III.2 Processing with your consent

POZUZ, s.r.o. may only process your personal data with your explicit consent.

IV. Period for which personal data will be stored

IV.1 We keep your personal data for the entire duration of the contractual relationship. After the termination of the contractual relationship and the settlement of all obligations arising from or related to the contract (e.g. for the settlement of claims or the conduct of judicial, administrative or arbitration proceedings), we retain your personal data for the necessary period, namely for 5 years after the termination of the contractual relationship.

IV.2 If we process personal data for the purpose of creating an offer, the data will be
processed for the duration of the contract negotiations between you and POZUZ, s.r.o., but no longer than 1 year from your request.

IV.3 In the case of publication of your photographs in the company newsletter or on the website of POZUZ, s.r.o., personal data is stored for two years after the photo is removed from the company newsletter or the company website.

IV.4 Data from CCTV footage is stored within a time loop for a maximum of two working days, after which it is deleted.

V. Which entities have access to your data

In order to ensure the quality of our products and services, it is necessary for other third parties to have access to your products. These are law or tax firms and other persons with whom we have a contract for the processing of personal data in order to protect your personal data.

VI. Your rights

VI.1 In particular, you have the right to receive information about the personal data we collect and process about you, the purpose and nature of the processing, and the recipients of the personal data, based on your written request.

VI.2 You also have the right to request an explanation in case of doubt as to whether personal data is processed in accordance with the legal requirements and, if justified, to have the error corrected.

VI.3 Your other rights are:

  • (a) the right to withdraw your consent at any time (even after withdrawal of consent, we may process personal data where required by law or where necessary for the performance of a contract or to protect our rights and legitimate interests);
  • (b) the right to information about the processing of your personal data;
  • (c) the right to rectify or supplement personal data;
  • (d) the right to request restriction of processing;
  • (e) the right to object to or complain about processing in certain cases;
  • (f) the right to request data portability;
  • (g) the right of access to personal data;
  • (h) the right to be informed of a personal data breach in certain cases;
  • (i) the right to erasure of personal data (the right to be "forgotten") in certain cases;
  • (j) the right to file a complaint with the Office for Personal Data Protection, located at Pplk. Sochora 27, 170 00 Prague 7, www.uoou.cz;
  • (k) other rights set out in Act No. 101/2000 Coll., on the Protection of Personal Data, as amended, and in the GDPR.
